Terms of Service

1. Acceptance

By creating an account, making a purchase, or otherwise accessing FitProp AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by FitProp AI ("we," "us," "our"). These Terms may be updated periodically; continued use after an update constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service you represent that you meet this minimum age, have the legal capacity to enter into these Terms, and will provide accurate information at signup. Accounts found to belong to minors below this age may be terminated without notice.

3. Your account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We are not liable for losses resulting from unauthorized account access that you could have prevented by using reasonable security practices.

4. Subscription billing

Paid plans (Basic, Pro, Challenge) are billed in advance on a recurring basis ("monthly") through our payment processor, Stripe. By subscribing you authorize us to charge your payment method at the start of each billing cycle. Subscriptions automatically renew at the end of each period unless you cancel beforehand.

Prices are listed in USD unless otherwise indicated. We may change prices with at least 30 days' notice; the new price takes effect at the start of your next billing cycle.

5. Cancellation and refunds

You may cancel your subscription at any time via Settings → Membership, or via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period — you retain access until then. No partial refunds are issued for the unused portion of a billing period, except where required by applicable law.

One-time Challenge purchases (e.g. the $9 21-Day Challenge) are non-refundable once the challenge window has started. Refund requests for errors or duplicate charges can be sent to fitpropaisupport@gmail.com.

6. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law
• Post content that is harmful, harassing, defamatory, obscene, or infringing
• Impersonate another person or misrepresent your affiliation
• Attempt to gain unauthorized access to any account, system, or data
• Interfere with or disrupt the Service, including by uploading malware
• Scrape, crawl, or bulk-download the Service without express written permission
• Reverse-engineer or attempt to derive the source code of the Service

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion, with or without notice.

7. User content

You retain ownership of content you post (posts, stories, photos, comments). By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely for the purpose of operating and improving the Service.

You are solely responsible for the content you post and represent that you have the right to post it. We may remove content that violates these Terms or applicable law, without notice.

8. Our intellectual property

The Service, including its code, design, logos, and AI-generated training plans (other than user inputs), is owned by FitProp AI and protected by intellectual property laws. No license is granted except the limited right to use the Service per these Terms.

9. Health disclaimer

The Service provides fitness training plans, nutritional information, and coaching guidance for general informational purposes. It is NOT medical advice. Consult a qualified health professional before starting any new exercise or nutrition program, particularly if you have a pre-existing condition. You use the Service's fitness guidance at your own risk.

10. Warranties and disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content (including AI-generated plans) will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by law, FitProp AI, its affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use arising out of your use of the Service. Our aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.

12. Termination

You may terminate your account at any time via Settings → Delete Account. We may suspend or terminate your account for violation of these Terms or for any reason at our sole discretion. Upon termination, your right to use the Service ceases immediately; sections intended to survive (IP, liability, disclaimers, governing law) continue to apply.

13. Governing law

These Terms are governed by the laws of Hungary, without regard to its conflict of laws rules. Any dispute shall be resolved in the courts located in Budapest, Hungary, unless otherwise required by mandatory law in your jurisdiction.
